AgencyLeads LLC and AgencyLeads.com ("AgencyLeads," "us," "we," or "our") thank you for visiting the online and mobile resources we publish. We use the words "you" and "your" to mean you, the reader, and other visitors to our online and mobile resources who are, in all cases, over the age of 18. Our privacy statement ("this statement") informs you about the types of personal information we collect, how we use it, who we share it with and why, and what we do to try to protect it.

Online and mobile resources mean the websites and other internet features we own that allow you to interact with our websites, as well as any apps we've created and distributed to let our customers and followers view our online and mobile resources or otherwise interact with the content we provide.

What We Collect

We may collect personal information from the following groups: visitors to and users of our online and mobile resources; our customers; current members of our workforce and those who apply for posted jobs; and third-party vendors and business partners.

Personal information generally means information that can be used to identify you or that can be easily linked to you (for example, your name, address, telephone number, email address, and date of birth). The privacy laws in some jurisdictions include unique elements in what they consider to be the personal information of the consumers or data subjects they protect. If those laws apply to us, as in the case of the California Consumer Privacy Act ("CCPA") or European General Data Protection Regulation ("GDPR"), our use of the phrase "personal information" includes the unique elements required by such laws.

The categories of information we collect from each of these groups, and the ways in which we use it, differ. It is possible that the same person could fall into more than one group. Most of this statement addresses our processing and sharing of personal information collected from visitors to and users of our online and mobile resources and our customers.

We also collect and retain the types of professional or employment-related personal information you would expect an employer to have about its existing and former workforce and new job applicants. Like all businesses, we also interact with existing and potential vendors and business partners from whom we collect certain personal information in connection with our contractual and business relationships. This information is typically limited to minimum business contact information, and we use it to manage, administer, and perform under our contracts.

Who We Collect Personal Information From

There are two types of information we obtain from you online and then store and use: (i) non-personal information collected automatically from each visitor, such as your device operating system; and (ii) personal information that you voluntarily provide to us or that is collected automatically.

By using our online and mobile resources or purchasing our products or services, you signify that you agree with this section of our privacy statement and that we may use and disclose your information as described.

Voluntarily Submitted Information. If you participate in certain activities via our online and mobile resources, you may be asked to provide information about yourself. The types of personal information we collect in those situations include identifiers (such as your name, email address, and phone number) and professional information (such as the business you are in, your website, your approximate monthly revenue, and how you currently get clients). We do not collect payment card information through this website. We do not sell, rent, or trade voluntarily submitted personal information with third parties; we do share it with the service providers named below so we can respond to your application.

If you don't want us to collect this type of personal information, please don't provide it. Participation is strictly your choice. Not participating may limit your ability to take full advantage of the online and mobile resources, but it will not affect your ability to access information available to the general public.

Some of the ways you voluntarily give us your personal information and how we use it:

Emails and Online Forms — When you send us an email or fill out an online form, your email address and any other personal information in the content of your message is retained by us and used to respond to you and process your request. Depending on the information provided, communications from us may be in the form of emails, telephone calls, and/or text messages. We may also send you information about our products or services we think may be of interest to you.

Registering for an Account — When you register for an account, you submit personal information such as your name and email address, which we retain and use to create and manage your account and communicate with you.

Registering for Events — When you register for services, webinars, events, or programs we host, you submit the identifiers described above. If the event requires a fee, we may also ask for payment information. We use this to register you and send communications regarding the event.

Becoming a Customer — We use information provided by our customers to perform our contractual obligations, provide the products and services purchased, manage their accounts, and communicate with them.

Automatically Collected Information. When you visit our online and mobile resources, basic information is passively collected through your web browser via tracking technologies such as cookies, scripts, and pixels. The analytics and advertising technologies we currently use are:

• PostHog (hosted in the EU) — product and website analytics: page views, clicks, scrolling, and interaction heatmaps. See PostHog's privacy policy.
• Vercel Web Analytics — aggregate page-view statistics from our hosting provider. See Vercel's privacy policy.
• ClickMagick — advertising click and conversion tracking on our advertising landing pages and application flow. If you book a call after applying, we pass your email address to ClickMagick so we can attribute the booking to the ad or link that brought you here. See ClickMagick's privacy policy.
• Meta (Facebook) Pixel — on our advertising landing page only, to measure ad performance. Meta may set cookies and receive your IP address and browsing information on that page. See Meta's privacy policy.
• Vidalytics — video hosting and playback analytics for the videos embedded on this site. See Vidalytics' privacy policy.
• iClosed — the call-scheduling widget embedded on this site. See iClosed's privacy policy.
• Google Fonts — font files served by Google, which receives your IP address when they load. See Google's privacy policy.

We also store first-touch attribution data (such as UTM parameters, click IDs, the page you landed on, and the referring site) in your browser's local storage so that, if you later apply, we know which campaign or referral brought you to us.

The internet activity information collected includes such things as the domain name and IP address from which you accessed our resources; your browser type and operating system; the date, time, and length of your visit; the specific pages visited; and the links you used to reach or leave our resources.

If you access our resources from a mobile device, we may collect uniquely identifiable mobile device information. If location services are enabled on your device, we may receive geolocation information. If you do not want us to collect geolocation data, disable location services through your device settings.

We use automatically collected information to compile generic reports about our resources, administer and improve them, and enhance their functionality. We retain your personal information in accordance with applicable law and as long as necessary to carry out the purposes described above.

User Beware: External Sites, Apps, Links and Social Media. We maintain a presence on external social media platforms such as Facebook, LinkedIn, YouTube, and others, and our resources may contain links to third-party websites or apps. We are not responsible for the content on, or the privacy practices of, those platforms, sites, or apps. They have their own privacy policies and terms of use, which you should read.

When and With Whom We Share Personal Information

We use non-personal information to administer and improve our online and mobile resources and to make business decisions. We use voluntarily provided personal information to respond to your inquiries and provide the services you requested. We do not sell or rent your personal information to third-party data vendors or marketing companies. We disclose your information when required by law.

Affiliates. We may share your information, including personal information, within our family of companies, including AgencyClients. Those companies will use such information in generally the same manner described in this statement, which includes sending you information about their products, services, or initiatives that may be of interest to you.

Legally Compelled Disclosures. We may disclose your information to government authorities and other third parties when compelled to do so, at our discretion, or otherwise as required or permitted by law, including responding to court orders and subpoenas.

To Prevent Harm. We may disclose your information when we have reason to believe someone is causing injury to or interference with our rights or property, other users, or anyone else who could be harmed.

Business Transfer. If we or substantially all of our assets are acquired by one or more third parties as a result of an acquisition, merger, sale, reorganization, consolidation, or liquidation, personal information may be one of the transferred assets.

Vendors and Business Partners. We may share your information with vendors and third parties with whom we have a contractual relationship, such as those providing software, payment processing, data, or fulfillment services on our behalf. We attempt to bind such vendors to written contracts that restrict their use of the information to the business purpose for which it was provided. We cannot guarantee that all vendors will agree to, or always fully comply with, these requirements.

Service Providers Who Process Your Application. When you submit (or begin) our application form, the information you enter is processed by the following providers on our behalf:

• Formspree — receives the submitted form and forwards it to our team by email.
• iClosed — receives your name, email, and phone number to schedule your call.
• Zapier and GoHighLevel (HighLevel) — our CRM and follow-up automation. If you enter your name, email, and phone number but do not finish the application, we retain what you entered and may follow up with you about completing it.
• Slack — our internal team messaging tool, which receives a notification with your application answers so the team can prepare for your call.
• ClickMagick — receives your email address after a booking, for advertising attribution as described above.

Artificial Intelligence. This website does not send your information to AI systems. Our software product, AgencyLeads (at app.agencyleads.com), uses AI providers (including Anthropic and OpenAI) to process business contact data on behalf of its customers; that processing is governed by the separate product privacy policy and data processing addendum, which name every subprocessor.

Your Rights and Options

You do not have to provide personal information to enjoy most features of our online and mobile resources, and you can opt out of activities like newsletters and announcements. Residents of California and data subjects whose personal information was obtained while in a GDPR Jurisdiction have certain additional rights.

If we are using your personal information to send you materials such as newsletters or product alerts via text or email, and you decide you no longer want to receive them, you may opt out by following the opt-out instructions in the communication (e.g., replying "STOP" to a text), or by contacting us using the information below. It may take a period of time to remove your name from our lists. You also have the ability to access, amend, and delete your personal information by contacting us.

Some browsers have a "do not track" feature. At this time, we do not specifically respond to browser "do not track" signals.

Children's Privacy

Our online and mobile resources are directed to business owners and are not intended for use by children. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that someone under 18 has submitted personal information, we will delete it. How We Protect Collected Personal Information

We take reasonable security precautions to protect the personal information provided to our online and mobile resources, including technical, organizational, and administrative measures consistent with accepted industry standards and applicable law. We cannot, however, guarantee that your information will be free from unauthorized access, or that loss, misuse, destruction, or alteration will not occur. Except for our duty to maintain reasonable security under applicable law, we disclaim other liability for such events. We periodically review and update our security measures, and we maintain incident response procedures that are activated if we become aware that personal information was likely compromised.

The California Consumer Privacy Act

When we collect personal information from California residents, we become subject to, and those residents have rights under, the California Consumer Privacy Act ("CCPA"). For purposes of this section, "you" and "your" mean only such California residents.

We collect the following categories of personal information: identifiers such as name, email address, telephone number, and IP address; professional information such as your business and approximate revenue; commercial information such as products or services purchased; and internet or electronic activity such as pages visited and interactions with our resources. We may disclose this information for one or more business purposes permitted by the CCPA. We do not sell personal information for money. Our use of advertising cookies and pixels (such as the Meta Pixel and ClickMagick, described above) may be considered "sharing" for cross-context behavioral advertising under the CCPA as amended by the CPRA. You may opt out of such sharing at any time by contacting us at the email below, and we will disable those technologies for you or process your request as the law requires.

You have the right to request disclosure, access, and deletion of your personal information. We will not discriminate against you for exercising these rights. You can exercise these rights up to two times every 12 months by contacting us using the information below. The CCPA only allows us to act on your request if we can verify your identity or authority, so you will need to follow our identity-verification instructions.

The EU General Data Protection Regulation

To the extent we collect personal information from data subjects located in GDPR Jurisdictions, the lawful bases on which we rely are legitimate interest (responding to your application and operating and measuring this website) and, where required for non-essential cookies and similar technologies, consent. We do not sell your personal information to third parties, and no decision producing legal or similarly significant effects about you is made by automated means without human involvement. Most of the service providers named in this statement are located in the United States, so your information may be transferred outside the EEA; where that happens we rely on safeguards such as the providers' Standard Contractual Clauses or their participation in the EU-U.S. Data Privacy Framework. You have rights of access, correction, deletion, portability, and restriction or objection. To exercise any of these rights, contact us at the email below. If you are not satisfied with how we handle your request, you have the right to complain to your data protection regulator.

Changes to This Privacy Statement

This privacy statement is effective as of the date it is posted. The English language version is the controlling version regardless of any translation. We reserve the right to change or update this statement from time to time. Please check periodically for changes, since all information collected is subject to the statement in place at that time.
